America's 'untouchables': the silent power of the caste system

We cannot fully understand the current upheavals, or almost any turning point in American history, without accounting for the human pyramid that is encrypted into us all: the caste system. By Isabel Wilkerson in The Guardian 


In the winter of 1959, after leading the Montgomery bus boycott that arose from the arrest of Rosa Parks and before the trials and triumphs to come, Martin Luther King Jr and his wife, Coretta, landed in India, in the city then known as Bombay, to visit the land of Mahatma Gandhi, the father of nonviolent protest. They were covered in garlands upon arrival, and King told reporters: “To other countries, I may go as a tourist, but to India I come as a pilgrim.”

He had long dreamed of going to India, and they stayed an entire month. King wanted to see for himself the place whose fight for freedom from British rule had inspired his fight for justice in America. He wanted to see the so-called “untouchables”, the lowest caste in the ancient Indian caste system, whom he had read about and had sympathy for, but who had still been left behind after India gained its independence the decade before.

He discovered that people in India had been following the trials of his own oppressed people in the US, and knew of the bus boycott he had led. Wherever he went, the people on the streets of Bombay and Delhi crowded around him for an autograph. At one point in their trip, King and his wife journeyed to the southern tip of the country, to the city of Trivandrum in the state of Kerala, and visited with high-school students whose families had been untouchables. The principal made the introduction.

“Young people,” he said, “I would like to present to you a fellow untouchable from the United States of America.”

King was floored. He had not expected that term to be applied to him. He was, in fact, put off by it at first. He had flown in from another continent, and had dined with the prime minister. He did not see the connection, did not see what the Indian caste system had to do directly with him, did not immediately see why the lowest-caste people in India would view him, an American Negro and a distinguished visitor, as low-caste like themselves, see him as one of them. “For a moment,” he wrote, “I was a bit shocked and peeved that I would be referred to as an untouchable.”

Then he began to think about the reality of the lives of the people he was fighting for – 20 million people, consigned to the lowest rank in the US for centuries, “still smothering in an airtight cage of poverty,” quarantined in isolated ghettoes, exiled in their own country.

And he said to himself: “Yes, I am an untouchable, and every negro in the United States of America is an untouchable.” In that moment, he realised that the land of the free had imposed a caste system not unlike the caste system of India, and that he had lived under that system all of his life. It was what lay beneath the forces he was fighting in the US.

What Martin Luther King Jr, recognised about his country that day had begun long before the ancestors of our ancestors had taken their first breaths. More than a century and a half before the American Revolution, a human hierarchy had evolved on the contested soil of what would become the United States – a concept of birthright, the temptation of entitled expansion that would set in motion what has been called the world’s oldest democracy and, with it, a ranking of human value and usage.

It would twist the minds of men, as greed and self-reverence eclipsed human conscience and allowed the conquering men to take land and human bodies that they convinced themselves they had a right to. If they were to convert this wilderness and civilise it to their liking, they decided, they would need to conquer, enslave or remove the people already on it, and transport those they deemed lesser beings in order to tame and work the land to extract the wealth that lay in the rich soil and shorelines.

To justify their plans, they took pre-existing notions of their own centrality, reinforced by their self-interested interpretation of the Bible, and created a hierarchy of who could do what, who could own what, who was on top and who was on the bottom and who was in between. There emerged a ladder of humanity, global in nature, as the upper-rung people would descend from Europe, with rungs inside that designation – the English Protestants at the very top, as their guns and resources would ultimately prevail in the bloody fight for North America. Everyone else would rank in descending order, on the basis of their proximity to those deemed most superior. The ranking would continue downward until one arrived at the very bottom: African captives transported in order to build the New World and to serve the victors for all their days, one generation after the next, for 12 generations.

There developed a caste system, based upon what people looked like – an internalised ranking, unspoken, unnamed and unacknowledged by everyday citizens even as they go about their lives adhering to it and acting upon it subconsciously, to this day. Just as the studs and joists and beams that form the infrastructure of a building are not visible to those who live in it, so it is with caste. Its very invisibility is what gives it power and longevity. And though it may move in and out of consciousness, though it may flare and reassert itself in times of upheaval and recede in times of relative calm, it is an ever-present through-line in the country’s operation.

A caste system is an artificial construction, a fixed and embedded ranking of human value that sets the presumed supremacy of one group against the presumed inferiority of others, on the basis of ancestry and often of immutable traits – traits that would be neutral in the abstract, but are ascribed life-and-death meaning in a hierarchy favouring the dominant caste whose forebears designed it. A caste system uses rigid, often arbitrary boundaries to keep the ranked groupings apart, distinct from one another and in their assigned places.

Throughout human history, three caste systems have stood out. The tragically accelerated, chilling and officially vanquished caste system of Nazi Germany. The lingering, millennia-long caste system of India. And the shape-shifting, unspoken, race-based caste pyramid in the US. Each version relied on stigmatising those deemed inferior in order to justify the dehumanisation necessary to keep the lowest-ranked people at the bottom, and to rationalise the protocols of enforcement. A caste system endures because it is often justified as divine will, originating from a sacred text or the presumed laws of nature, reinforced throughout the culture and passed down through the generations.

As we go about our daily lives, caste is the wordless usher in a darkened theatre, the flashlight cast down the aisles, guiding us to our assigned seats for a performance. The hierarchy of caste is not about feelings or morality. It is about power: which groups have it and which do not. It is about resources: which caste is seen as worthy of them, and which are not; who gets to acquire and control them, and who does not. It is about respect, authority and assumptions of competence: who is accorded these, and who is not.

As a means of assigning value to entire swaths of humankind, caste guides each of us, often beyond the reaches of our awareness. It embeds into our bones an unconscious ranking of human characteristics, and sets forth the rules, expectations and stereotypes that have been used to justify brutalities against entire groups within our species. In the American caste system, the signal of rank is what we call race, the division of humans on the basis of their appearance. In the US, race is the primary tool and the visible decoy – the frontman – for caste.

Race does the heavy lifting for a caste system that demands a means of human division. If we have been trained to see humans in the language of race, then caste is the underlying grammar that we encode as children, as when learning our mother tongue. Caste, like grammar, becomes an invisible guide not only to how we speak, but to how we process information – the autonomic calculations that figure into a sentence without our having to think about it. Many of us have never taken a class in grammar, yet we know in our bones that a transitive verb takes an object, that a subject needs a predicate, and we know without thinking the difference between third-person singular and third-person plural. We might mention “race”, referring to people as black or white or Latino or Asian or indigenous, when what lies beneath each label is centuries of history, and the assigning of assumptions and values to physical features in a structure of human hierarchy.

What people look like – or rather, the race they have been assigned, or are perceived to belong to – is the visible cue to their caste. It is the historic flashcard to the public, showing how people are to be treated, where they are expected to live, what kinds of positions they are expected to hold, whether they belong in this section of town or that seat in a boardroom, whether they should be expected to speak with authority on this or that subject, whether they will be administered pain relief in a hospital, whether their neighbourhood is likely to adjoin a toxic waste site or to have contaminated water flowing from their taps, whether they are more or less likely to survive childbirth in the most advanced nation in the world, whether they may be shot by authorities with impunity.

Caste and race are neither synonymous nor mutually exclusive. They can and do coexist in the same culture, and serve to reinforce each other. Caste is the bones, race the skin. Race is what we can see, the physical traits that have been given arbitrary meaning and become shorthand for who a person is. Caste is the powerful infrastructure that holds each group in its place.

Caste is fixed and rigid. Race is fluid and superficial, subject to periodic redefinition to meet the needs of the dominant caste in what is now the US. While the requirements to qualify as white have changed over the centuries, the fact of a dominant caste has remained constant from its inception – whoever fit the definition of white, at whatever point in history, was granted the legal rights and privileges of the dominant caste. Perhaps more critically and tragically, at the other end of the ladder, the subordinated caste, too, has been fixed from the beginning as the psychological floor beneath which all other castes cannot fall.

Caste is not a term often applied to the US. It is considered the language of India or feudal Europe. But some anthropologists and scholars of race in the US have made use of the term for decades. Before the modern era, one of the earliest Americans to take up the idea of caste was the antebellum abolitionist and US senator Charles Sumner, as he fought against segregation in the north. “The separation of children in the Public Schools of Boston, on account of color or race,” he wrote, “is in the nature of Caste, and on this account is a violation of Equality.” He quoted a fellow humanitarian: “Caste makes distinctions among creatures where God has made none.”

We cannot fully understand the current upheavals, or almost any turning point in American history, without accounting for the human pyramid that is encrypted into us all. The caste system, and the attempts to defend, uphold or abolish the hierarchy, underlay the American civil war and the civil rights movement a century later, and pervade the politics of the 21st-century US. Just as DNA is the code of instructions for cell development, caste has been the operating system for economic, political and social interaction in the US since the time of its gestation.

In 1944, the Swedish social economist Gunnar Myrdal and a team of the most talented researchers in the country produced a 2,800-page, two-volume work that is still considered perhaps the most comprehensive study of race in the US. It was titled An American Dilemma. Myrdal’s investigation into race led him to the realisation that the most accurate term to describe the workings of US society was not race, but caste – and that perhaps it was the only term that really addressed what seemed a stubbornly fixed ranking of human value.

The anthropologist Ashley Montagu was among the first to argue that race is a human invention – a social construct, not a biological one – and that in seeking to understand the divisions and disparities in the US, we have typically fallen into the quicksand and mythology of race. “When we speak of ‘the race problem in America’,” he wrote in 1942, “what we really mean is the caste system and the problems which that caste system creates in America.”

There was little confusion among some of the leading white supremacists of the previous century as to the connections between India’s caste system and that of the American south, where the purest legal caste system in the US existed. “A record of the desperate efforts of the conquering upper classes in India to preserve the purity of their blood persists to until this very day in their carefully regulated system of castes,” wrote Madison Grant, a popular eugenicist, in his 1916 bestseller, The Passing of the Great Race. “In our Southern States, Jim Crow cars and social discriminations have exactly the same purpose.”

In 1913, Bhimrao Ambedkar, a man born to the bottom of India’s caste system, born an untouchable in the central provinces, arrived in New York City from Bombay. He came to the US to study economics as a graduate student at Columbia, focused on the differences between race, caste and class. Living just blocks from Harlem, he would see first-hand the condition of his counterparts in the US. He completed his thesis just as the film The Birth of a Nation – the incendiary homage to the Confederate south – premiered in New York in 1915. He would study further in London and return to India to become the foremost leader of the untouchables, and a pre-eminent intellectual who would help draft a new Indian constitution. He would work to dispense with the demeaning term “untouchable”. He rejected the term Harijans, which had been applied to them by Gandhi, to their minds patronisingly. He renamed his people Dalits, meaning “broken people” – which, due to the caste system, they were.

It is hard to know what effect his exposure to the American social order had on him personally. But over the years, he paid close attention, as did many Dalits, to the subordinate caste in the US. Indians had long been aware of the plight of enslaved Africans, and of their descendants in the US. Back in the 1870s, after the end of slavery and during the brief window of black advancement known as Reconstruction, an Indian social reformer named Jyotirao Phule found inspiration in the US abolitionists. He expressed hope “that my countrymen may take their example as their guide”.

Many decades later, in the summer of 1946, acting on news that black Americans were petitioning the United Nations for protection as minorities, Ambedkar reached out to the best-known African American intellectual of the day, WEB Du Bois. He told Du Bois that he had been a “student of the Negro problem” from across the oceans, and recognised their common fates.

“There is so much similarity between the position of the Untouchables in India and of the position of the Negroes in America,” Ambedkar wrote to Du Bois, “that the study of the latter is not only natural but necessary.”

Du Bois wrote back to Ambedkar to say that he was, indeed, familiar with him, and that he had “every sympathy with the Untouchables of India”. It had been Du Bois who seemed to have spoken for the marginalised in both countries as he identified the double consciousness of their existence. And it was Du Bois who, decades before, had invoked an Indian concept in channelling the “bitter cry” of his people in the US: “Why did God make me an outcast and a stranger in mine own house?”

I began investigating the American caste system after nearly two decades of examining the history of the Jim Crow south, the legal caste system that grew out of enslavement and lasted into the early 70s, within the lifespans of many present-day Americans. I discovered that I was not writing about geography and relocation, but about the American caste system – an artificial hierarchy in which most everything that you could and could not do was based upon what you looked like, and which manifested itself north and south. I had been writing about a stigmatised people – 6 million of them – who were seeking freedom from the caste system in the south, only to discover that the hierarchy followed them wherever they went, much in the way that the shadow of caste (as I would soon discover) follows Indians in their own global diaspora.

The American caste system began in the years after the arrival of the first Africans to the Colony of Virginia in the summer of 1619, as the colony sought to refine the distinctions of who could be enslaved for life and who could not. Over time, colonial laws granted English and Irish indentured servants greater privileges than the Africans who worked alongside them, and the Europeans were fused into a new identity – that of being categorised as white, the polar opposite of black. The historian Kenneth M Stampp called this assigning of race a “caste system, which divided those whose appearance enabled them to claim pure Caucasian ancestry from those whose appearance indicated that some or all of their forebears were Negroes”. Members of the Caucasian caste, as he called it, “believed in ‘white supremacy’, and maintained a high degree of caste solidarity to secure it”.

While I was in the midst of my research, word of my inquiries spread to some Indian scholars of caste based in the US. They invited me to speak at an inaugural conference on caste and race at the University of Massachusetts in Amherst, the town where WEB Du Bois was born and where his papers are kept.

There, I told the audience that I had written a 600-page book about the Jim Crow era in the American south – the time of naked white supremacy – but that the word “racism” did not appear anywhere in the narrative. I told them that, after spending 15 years studying the topic and hearing the testimony of the survivors of the era, I had realised that the term was insufficient. “Caste” was the more accurate term, and I set out to them the reasons why. They were both stunned and heartened. The plates of Indian food kindly set before me at the reception thereafter sat cold due to the press of questions and the sharing that went on into the night.

At a closing ceremony, the hosts presented to me a bronze-coloured bust of the patron saint of the low-born of India, Bhimrao Ambedkar, the Dalit leader who had written to Du Bois all those decades before.

It felt like an initiation into a caste to which I had somehow always belonged. Over and over, they shared stories of what they had endured, and I responded in personal recognition, as if even to anticipate some particular turn or outcome. To their astonishment, I began to be able to tell who was high-born and who was low-born among the Indian people there, not from what they looked like, as one might in the US, but on the basis of the universal human response to hierarchy – in the case of an upper-caste person, an inescapable certitude in bearing, demeanour, behaviour and a visible expectation of centrality.

On the way home, I was snapped back into my own world when airport security flagged my suitcase for inspection. The TSA worker happened to be an African American who looked to be in his early 20s. He strapped on latex gloves to begin his work. He dug through my suitcase and excavated a small box, unwrapped the folds of paper and held in his palm the bust of Ambedkar that I had been given.

“This is what came up in the X-ray,” he said. It was heavy like a paperweight. He turned it upside down and inspected it from all sides, his gaze lingering at the bottom of it. He seemed concerned that something might be inside.

“I’ll have to swipe it,” he warned me. He came back after some time and declared it OK, and I could continue with it on my journey. He looked at the bespectacled face, with its receding hairline and steadfast expression, and seemed to wonder why I would be carrying what looked like a totem from another culture.

“So who is this?” he asked.

“Oh,” I said, “this is the Martin Luther King of India.”

“Pretty cool,” he said, satisfied now, and seeming a little proud.

He then wrapped Ambedkar back up as if he were King himself, and set him back gently into the suitcase.

India: Where does one turn when law, political parties and the state turn their back on justice?

Anand Teltumbde, one of India’s important and courageous thinkers, just turned 70 in prison. He, along with Sudha Bharadwaj and others, is being held in the Bhima Koregaon case. They are being repeatedly denied bail. Varavara Rao, poet and Maoist intellectual, contracted COVID and has been subject to degrading and humiliating conditions at the age of 80. The overwhelming power that the Unlawful Activities (Prevention) Act gives to the state, the sheer impunity with which government can treat this group of accused, the Kafkaesque role of the judiciary in denying bail and making procedural safeguards ineffective, and the deafening political silence on their detention, all warrant deeper reflection. The accused in the Bhima Koregaon case are not the first to be victimised in this way; and they will not be the last. The UAPA is being used to target protest from Assam to Delhi.

Anand Teltumbde’s work, particularly “Republic of Caste”, presciently forecast his own condition. He, like the others, has drawn support from the usual petition-writing crowd of intellectuals. But his case provides a disturbing window on the political loneliness of a genuine intellectual in Indian conditions.

Here is a well-known Dalit intellectual being put in prison and yet no serious political protest, even from Dalit politicians. Teltumbde had, in another context written, “When Sudhir Dhawale, a Dalit activist, was arrested in 2011 on the trumped up charge of being a Naxalite and incarcerated for nearly four years, there was hardly any protest from the community.” This phenomenon of figures like Teltumbde not drawing broader political support requires some reflection. Teltumbde himself, in part, attributed this to divisions amongst Dalits, and their greater faith in the state. But his work points towards a subtler reason.

For all of India’s handwringing, that we need to escape identity politics, there is a great antipathy to anyone who tries to escape it. Teltumbde is one of those rare figures who argued that the Left and liberals failed to take caste seriously, and caste mobilisation failed to take class and economics seriously. But the result is a kind of suspension in between two constructions: Most of society does not get outraged because he is often reduced to being a Dalit intellectual; Dalits don’t get outraged because he becomes a “Left” intellectual. The blunt truth is that, if we leave the rarefied world of petitions, the only modality of protest that is politically effective is the one that has the imprimatur of community mobilisation behind it. If you can show a community identity is affected, all hell will break loose; without it, there is no political protest.


Teltumbde was also prescient about the way the term “Left” is used in India. Teltumbde himself is closer to the Left in his economic imagination. But the rhetorical function of the “Left” in India is not to describe the contest over the free market versus the state. The rhetorical function of the “Left” is to describe any ideological or political current that, while recognising the importance of identity, wants to escape its compulsory or simplistic character; so any broadly liberal position or a position that distances itself from “my community right or wrong” also becomes Left. For Hindutva, anyone who resists or transcends the narcissisms of collective identity becomes “Left.” But the same is increasingly true of other identities — Maratha, Jat, Dalit, Rajput. “Left” is anyone who complicates identity claims. That, rather than secular versus communal, is the big chasm in Indian politics. But the result is that if you are labelled “Left” in this way, you will have no political protection.

The charge of Maoism is the hyper version of this “Left” in the context of Adivasi mobilisation. Which is why the entire political class, and so much of India’s discursive space, keeps invoking the “Left” spectre. And Teltumbde was insightful in thinking that once you had been labelled Left in India, it was easy to secure a diminution in your legal and cultural standing. Even the Courts will turn off their thinking cap. It is in this that the genuine intellectual enterprise is a lonely one, whose disastrous political consequences Teltumbde is facing.

The Bhima Koregaon cases also throw a spotlight on so many state institutions. The UAPA, and its ubiquitous use is a travesty in a liberal democracy. The lawyer, Abhinav Sekhri, has, in a recent article (“How the UAPA is perverting the Idea of Justice”, Article14.com) pointed out two basic issues with the law. The law is designed in a way that it makes the question of innocence or guilt almost irrelevant. It can, in effect, inflict punishment without guilt. The idea that people like Teltumbde or the exemplary Bharadwaj cannot even get bail underscores this point. And second, the safeguards of our criminal justice process work unevenly at the best of times. But in the case of the UAPA, the courts have often, practically, suspended serious scrutiny of the state. What legitimises this conduct of the court is two things: The broader ideological construction of the “Left” as an existential threat. And the impatience of society with procedural safeguards. The UAPA has in some senses become the judicial version of the encounter — where the suspension of the normal meaning of the rule of law is itself seen as a kind of justice.

The state has been going after Varavara Rao for his entire life. He is a complicated figure. He is an extraordinarily powerful poet who made visible the exploitative skeins of Indian society; his poetry, even in translation, cannot fail to move you out of a complacent slumber. He was formidable in consciousness raising. Of this group, his ideological excusing of horrendous Maoist excesses, has been indefensible and disturbing. His moral stance once promoted a deeply meditative critique on the morality of revolutionary violence by Apoorvanand (“‘Our’ Violence Versus ‘Their’ Violence”, Kafila.online).

But the farce that the Indian state is enacting in pursuing Varavara Rao in the Bhima Koregaon prosecutions is proving him correct in two ways. First, in his insistence that what is known as bourgeois law is a sham in its own terms; the rule of law indeed is rule by law. And second, that repression and degradation is indeed the argument of a despotic state. Where does one turn when law, political parties and the state turn their back on justice?

The Congress Party needs to die

My remark on a TV show, that the “Congress must die”, has triggered a debate, perhaps somewhat prematurely, on the role of the country’s principal Opposition party in the times to come. Some of the early reactions have been virulent. Perhaps the timing of the remark made it look like an attempt to kick someone when he is down. And the metaphor of death invited strong emotional reaction.

Let me, therefore, spell out the rationale in the hope that it would generate a more serious and constructive debate. Let me begin by clarifying what this remark was not. One, it was not a knee-jerk emotional outburst in reaction to an exit poll. I had expressed a similar opinion earlier too. The broad judgment is not dependent on the exit polls, unless, of course, the Congress manages to defeat the BJP in the states where it is a direct Congress-BJP contest. Two, I harbour no animus or khundak against Congress leaders. I have said publicly that Rahul Gandhi is more sincere than most political leaders that I have met and far more intelligent than everyone thinks.

Three, this is not a forecast. I know big political parties don’t die easily, and not just because they lose two elections. I don’t have Pragya Thakur’s powers to give shrapa (curse), so you may call it my wish. Finally, this wish is not born out of a congenital anti-Congressism. I have always maintained that Ram Manohar Lohia’s anti-Congressism was a short-term political tactic and must not be turned into an ideology. Unlike most Lohiaites, I have come to admire the role of Nehru and the Congress party in nation-building in the first two decades after Independence.

To my mind, the core issue is assessing the Congress’ potential in acting as a bulwark against the onslaught on the foundations of our republic. There are two assumptions here. One, the rise of the Narendra Modi-led BJP presents a threat to the core constitutional values of democracy and diversity. Two, as the principal national Opposition party, the Congress carries the first charge of protecting the republic against this onslaught.

Once we agree on these, and I think most of my critics would share these assumptions, then we can enter into a meaningful debate and disagreement on the following questions: Has the Congress done justice to this historical responsibility in the last five years? Or, can it be trusted to perform this responsibility in the foreseeable future? My answer is a clear no. The Congress is not just not up to this task, it is a hurdle for those who wish to do so.

Let us look at what the Congress did, or rather didn’t, in the last five years. The Modi regime’s economic performance was below average. Did the Congress organise any nation-wide mass movement to articulate and mobilise the farmers’ distress, or the rising unemployment among the youth, or the small traders’ anger against the way the GST was being implemented, not to speak of the disaster of demonetisation? These five years were marked by a spate of lynching of Muslims and rising atrocities against Dalits. Did the Congress even articulate it coherently in a way that would make sense to non-Muslims and non-Dalits as well?

Or take this election, after the Congress got a dream launch-pad with victory in three assembly elections. Did the Congress do something in these three states that could be presented as an alternative to the Modi regime? Did the Congress have a message for the voters of this country? No doubt, it finally came out with a decent manifesto, but that is hardly a political message for the last person. Nor did it have a credible messenger. Pitted against Modi’s communicative onslaught, Rahul Gandhi carried little appeal. The Congress did not appear to have a strategy to handle the post-Pulwama “nationalist” blitz by the BJP. And it certainly had no roadmap for building a Mahagathbandhan: Just compare how the BJP brought back the Shiv Sena and the AGP with how the Congress dealt with alliances in UP, Bihar and Delhi.

I don’t overlook the odds the Congress was up against: The Modi government’s brazen misuse of state power, its mind-boggling money power and the near complete control over mainstream media. But did the Congress do what could be done under these constraints? Besides, the only reason why mainstream parties exist and flourish is their viability and reach. The Congress cannot say everyone must come to it because this is the only party that can take on the BJP and then give reasons why it couldn’t. 
Let’s focus on the future. The prospects of a second Modi regime bring with it two deeper challenges to our republic. On the one hand, we are walking towards electoral authoritarianism where the electoral mandate will replace any constitutional constraints. On the other hand, there is a slide towards non-theocratic majoritarianism, where minorities are reduced to the status of second-rate citizens. Do we expect the Congress to be the principal force to combat these two dangers? To my mind, the Congress does not seem to possess the vision, the strategy or the ground strength to take on this historic responsibility. If so, the Congress is not the instrument needed to save the republic.

Worse, the Congress is an obstacle to those who want to build an alternative. A large mainstream party acts like a magnet that catches a lot of energy around it. So, even when the Congress is unable to defeat the BJP, it ends up diverting and diffusing a lot of the energy that gets drawn to it. It won’t do the job and won’t let anyone else do it. Alternative politics cannot take off until it calls the bluff of “Vote for Congress or else…”, unless it begins to carry on its work as if the Congress did not exist. This is how the metaphor of death should be understood.

Of course, parties don’t wither away or die an instant death. There are two ways in which the Congress can “die”. There is death by attrition, where a big party keeps getting marginalised and gradually loses traction with the voters. This process takes many elections, perhaps many decades. This is exactly what the BJP would wish for the Congress. But there is also death by submergence, where the remaining energy of the party gets subsumed in a new, larger coalition. There is still a lot of energy in the country to take on the challenge to our republic. The ideal “death” for the Congress would be for this energy, inside and outside the Congress, to merge into a new alternative.

The dark metaphor of death is an invitation to think about a new birth. Or a rebirth?

The Myth of Bhima Koregaon Reinforces the Identities It Seeks to Transcend

Two hundred years ago, the last battle of the Anglo-Maratha war was fought at Koregaon village on the banks of Bhima river near Pune. The battle marked the firm hold of the British Empire in India. The British erected an obelisk at the battle ground in the memory of the dead. It has 49 names, 22 of them are identified by their ‘nak’ suffix as Mahars. It was construed as the testimony to the gallantry of Mahar soldiers, and was rightly used by the first batch of Mahar leaders such as Gopal Baba Walangkar, Shivram Janba Kamble and even Ramji Ambedkar, B.R. Ambedkar’s father, when pleading the British for the restoration of Mahar recruitment in the British army when it was stopped in 1893. The stoppage of Mahar recruitment was a consequence of the Indian uprising of 1857, after which the British reassessed their recruiting strategies to include only those from ‘martial races’ in the army.

But when Babasaheb Ambedkar painted the Battle of Bhima Koregaon as the battle of Mahar soldiers against their caste oppression in Peshwa rule, he was creating a pure myth. As myths are required to build movements, he perhaps saw its necessity then. But after a century, when it solidifies into a quasi-history and tends to push Dalits deeper into an identitarian marshland, it should become a worrisome matter. Many Dalit organisations recently formed a joint front to observe the 200th anniversary of this battle as a campaign to launch an attack on the new Peshwai, the rising Brahmanic rule of the Hindutva forces. Their long marches culminated into an Elgar Parishad (conference) at the Shaniwarwada at Pune on December 31. While the resolve to fight the Hindutva forces is certainly laudable, the myth used for the purpose may be grossly counterproductive insofar as it reinforces identitarian tendencies whereas the necessity is to transcend them.

As regards history, it is a fact that when the East India Company developed its military aspirations, it recruited Dalits in disproportionately large numbers, perhaps for their unflinching loyalty and faithfulness and also because they were cheaply available. One finds disproportionate numbers of the Namshudras in Bengal, the Parayas in Madras and the Mahars in Maharashtra in its army. If the Dalits wanted to claim significant contribution to the establishment of the British Raj in India, it may not be as such incorrect. But to attribute motive of fighting caste oppression to their soldiery shall be far-fetched and unhistorical.

The East India Company fought and won several battles from the first one in Plassey in 1757 before the last battle of the Anglo-Maratha war. Obviously, all of them were not against the Peshwas. Most of them were not even against the Hindus. They were simply wars between the two ruling powers, which their soldiers fought just as their duty. To make them appear as anti-caste or anti-religion will not only be factually incorrect, but also an erroneous understanding of historical caste. Caste, until after the late 19th century when there was a substantial spread of education among the Dalits, has been the life-world of people. They took caste as a natural order and their oppression as the fate that they had to meekly endure. Therefore, there was no question of any resistance to caste, leave apart physical war against them. Contrary to such myths of bravery, there is no evidence of any militant resistance the Dalits ever posed against the Brahmanic oppression.

With regard to formation of warring armies, they were not purely composed on communal lines. While the Dalit soldiers may be relatively in large numbers in British army, it is not that they did not exist in Muslim or Maratha armies. As with communities, all castes existed in all the armies. In the Battle of Koregaon, one of the three wings of the Peshawa infantry was Arabs, which had reportedly fought most fiercely and had most casualties. What could be their motivation? Did they want the Peshwa’s Brahmanic rule to triumph? The fact is that they simply fought as soldiers for their masters, as the Dalits did for theirs. It would be grossly erroneous to attribute loftier motives to them than this.

Before the battle of Koregaon on January 1, 1818, the Peshwas had been reduced to weaklings by the earlier two Anglo-Maratha wars. As a matter of fact, the Peshwa Bajirao II had fled Pune and was attempting to attack Pune from outside. Peshwa’s army comprised 20,000 cavalry and 8,000 infantry, out of which around 2,000 men, divided into three infantry parties each comprising 600 Arabs, Gosains and soldiers, mounted the attack. The majority of the attackers were Arabs, reputed to be the finest among the Peshwa soldiers. The Company troops comprised 834 men, including around 500 soldiers of the 2nd Battalion of the 1st Regiment of Bombay Native Infantry, which was manned predominantly by Mahar soldiers. Although there is no record of their exact number, it is obvious that all of them were not Mahars. Even going by the casualties, the majority of those died in the battle (27 out of 49) were not Mahars. The Peshwa army ultimately withdrew, fearing the arrival of a larger British force led by General Joseph Smith. In view of these factual details, it may be misleading to portray the battle as Mahars’ vengeance against the Peshwas’ Brahmanic rule.

There is no evidence that after the defeat of Peshwai, there was any relief that accrued to Mahars. As a matter of fact, their caste oppression continued unabated. Rather, as hinted earlier, the ungrateful British stopped their recruitment to the army, refusing to acknowledge their past bravery. They ignored their pleas to restore recruitment until threatened by the First World War, in the wake of which they restarted their recruitment. There is no dispute that the British colonial rule brought Dalits numerous benefits, to the extent that the very birth of the Dalit movement may be attributable to it. But it must simultaneously be understood that it was unintended and primarily dictated by their colonial logic. It is unfortunate that Dalits blind themselves to this reality with their identity blinkers.

It is equally incorrect to say that since the Peshwa forces belonged to the Maratha confederacy, they were the nationalist forces, and the defeating British forces were the imperialists. To see historical facts through the spectacles of a non-existent nation is equally condemnable. There was no concept of an Indian nation; as a matter of fact, this concept eludes us even to this day. Paradoxically, India itself is by and large a gift of British rule, having forged a political unity of vast landmass of the subcontinent. Those who have been driving it as a nation for their selfish gains are indeed debauched like Peshwas and are the biggest anti-nationals.

The Dalits do need to fight this new Peshwai recreated by the Hindutva marauders. For that, they better open their eyes to see the reality, rather than an ostrich-like look into the mythical past and imagine their greatness.

Why do Dalits support BJP?

AS a Dalit student from Maharashtra who became a Buddhist, my friend Chandan Kamble was curiously sceptical of Marxism. My Marxist friends on the leftist campus were equally sceptical of Chandan with his Afro hair and his perpetually smiling, piercing gaze.

He was sinfully prankish and was never bereft of a wild observation about anyone, perfect strangers included. He was at his acerbic best when within earshot of a dyed-in-the-wool communist. “In capitalism, man exploits man. In communism, it’s the other way around.” The kindergarten lines were deliberately parcelled and farmed out depending on the moment, and Chandan was a practitioner of precision timing, like a jester in a serious play.

The words may not be his, but they gained currency on the campus because of his love for political banter. At the same time, he got excellent grades from the MPhil tutor in international studies. “A politician is someone who knows which side his bread is buttered.” The banal words are suddenly making sense.

I have no idea where Chandan has disappeared. We were in the same hostel at Jawaharlal Nehru University. A common JNU friend in Princeton said he last saw him years ago in a US university campus, possibly Harvard. Why am I suddenly thinking of the missing Mahar friend whose cryptic homilies on politics and Marxism, in particular, I indulged but disagreed with? A possible answer lies in the question itself.

Why did the Marxists shun Dalits as Dalits? They worked hard to get the Dalit students priority in admission and so forth. Yet there was a pronounced aloofness at an intellectual level, a palpable snobbery. Or was it because B.R. Ambedkar had poured vitriol on Indian Marxists in his great work on the revival of the Dalit cause? If that was so, why didn’t any comrade woo the lowest in the caste heap to his or her side, ignoring or critiquing Ambedkar if they had a valid argument?

What puzzles me equally is the shocking ability of the BJP to woo Dalits — in Gujarat, in Uttar Pradesh and so forth. It is perhaps this worry that has sent me cartwheeling into the past. Here is a perfectly casteist party, one that Ambedkar would have loathed. He had described Hinduism in no uncertain terms as a “chamber of horrors”. And Ambedkar’s followers are today marching mindlessly, one should add, self-destructively into the Hindutva fold.

Of course, there is Chanakya’s wily wisdom at play. Divide and rule, Emperor Chandragupta’s Brahmin counsellor had decreed, way before the advent of colonialism of any stripe. It worked in Uttar Pradesh last month. Jatav versus non-Jatav Dalits; Yadav versus non-Yadavs among the other backward castes; something similar with Muslims is afoot. That’s BJP. What about the Marxists?

Indian Marxists, like their comrades elsewhere, are a threatened species. The BJP is out to swallow their two remaining hubs — one in the tiny tribal state of Tripura and the other, of course, Kerala, the redoubtable communist bastion. One should have thought that the BJP was a cause for serious worry. But the Marxists seem to have different priorities. They look keener to bring down the Mamata Banerjee government in Bengal, possibly in cahoots with the Congress. The BJP would be only too happy to let them do its dirty work.

The thought is horrifying for the sheer lack of sensitivity. The Marxists took a lead in fighting Indira Gandhi’s emergency, and they were a source of strength to the movement that ended in the Janata Party experiment. The experiment included the BJP then called the Jan Sangh. And the first thing that the Janata Party government did was to ban school textbooks on history that were authored by Romila Thapar, R.S. Sharma and Bipan Chandra.

The ground was laid in 1978 for the assault on Wendy Doniger’s study of Hinduism and A.K. Ramanujan’s Three Hundred Ramanayas — a brilliant research of the diverse Rama legends. The Marxists didn’t give up here, as they again came together with the BJP to shore up an anti-Congress V.P. Singh government in 1989.

For better or worse, they then came up with the formula of supporting non-BJP, non-Congress parties and alliances. There are three that fit the bill. They are Mamata Banerjee in Bengal, the Lalu-Nitish coalition in Bihar and the Aam Aadmi Party in Delhi. All three are targeted by the BJP. The Congress too has joined the expedition in two, barring Bihar, where it is a junior partner in the state government. The Marxists set up candidates against all three.

The problem is that these three are the ones they count among the 59 per cent that didn’t vote for the BJP. The three are also those that stopped the BJP juggernaut. All three are accused of corruption by the BJP, a ruse that is seen as a first step towards their dismissal.

Any sane observer of the unfolding Indian scenario would have thought that it was time all opposition parties came together as they once came up against Mrs Gandhi. What is happening instead is that one by one the non-Congress and non-BJP governments, including the Left Front, are coming in the cross hairs of the Modi establishment. It’s almost like Germany in the 1930s to give an overused but relevant example. There the communists and the social democrats were taken out one by one.

Chandan Kamble is perhaps watching today’s denouement with concern. He had a habit of mixing up metaphors. “We are all sailing in the same soup,” he would say. Will the Marxists be able to untangle the jumbled aphorisms?

It is worrying that the main Marxist groups — and not to forget the Congress — seem to believe that the threat posed to India’s democracy by the BJP is comparable with Mamata Banerjee’s rule in Bengal and Arvind Kejriwal’s in Delhi. Could Chandan Kamble be right?

On Dalit-Muslim unity - The Dalits’ dream of Pakistan

A group of Pakistani Dalits in Mirpurkhas gathered at their town hall recently. They vowed to initiate a movement to assert their distinct political identity, and fight for their communities’ rights.

The word ‘dalit’ literally means ‘oppressed people’; it has been in use since the 19th century to describe communities that fall outside of the four-caste Hindu hierarchy. These ‘outcastes’ or ‘untouchables’ have been subject to horrendous discrimination, in all spheres of life, for at least the past 2,000 years.

As political consciousness in undivided India arose towards the end of the British Raj, a number of Dalit leaders emerged to formulate and push forward their own political demands.

Most prolific among them was Dr B.R. Ambedkar, who did not trust the upper-caste-dominated Congress with the political interests and aspirations of his communities. He made a strong case for a separate electorate for Dalits in the 1930-32 Round Table Conferences. The Muslim League had also made the same demand the centre of their politics.

The Communal Award of 1932 accepted the positions of both, but Gandhi persuaded Ambedkar to agree to reserved seats for Dalits within a joint electorate system, rather than having Dalit voters elect Dalit parliamentarians separately.

The Government of India Act, 1935 included a schedule of castes that were subject of its specific clauses. The term ‘Scheduled Castes’ thus replaced ‘Dalits’ in official parlance. In Pakistan, the government also notified 40 castes as ‘Scheduled’ through an ordinance in 1957, which included Bheel, Kohli and Menghwar.

Dalits did establish a distinct identity — but their mobility within politics continued to remain restricted due to entrenched caste barriers.

Dr Ambedkar made it to the Constituent Assembly of India only with the help of fellow Dalit leader, Jogendra Nath Mandal.

Mandal, from East Bengal, belonged to the Namahsudra (an ‘untouchable’) caste. He was long associated with the Muslim League, and had served as a minister in the Suharwardy-led government of Bengal in 1946. Being a Dalit leader, he had found common cause with poor Bengali Muslims fighting against landlords and moneylenders, the majority of whom were upper-caste Hindus.

He supported the creation of Pakistan, and was made temporary chairman of the first Constituent Assembly. He served as a federal minister in the first cabinet.

Mandal’s elevation was perceived as a gesture towards Dalits, indicating that Muslim Pakistan would treat them better than the caste-plagued Hindu Congress. This gesture proved short-lived — and soon turned into a tale of betrayal.

In March 1949, a Dalit member of the first Constituent Assembly motioned to amend the Objectives Resolution to include ‘Scheduled Castes’ in the language which vowed to safeguard interests of minorities. Sardar Abdur Rab Nishtar defended the original phrasing, arguing that specificity was not required; whether Muslim or Hindu, any marginalised community would be protected.

The amendment was turned down, which was a denial of the everyday realities of our society, where oppression is encoded into the caste system.

It became evident that Pakistan divides its population into two groups only — Muslims and non-Muslims — and that when it comes to sharing state resources and privileges, Muslims would benefit from their preferential status at the expense of non-Muslims.

Mandal resigned in 1950. If one is to trust the veracity of his resignation letter available online, he offered a scathing indictment of Pakistan’s failure to safeguard its minorities. He accused the rulers of extreme forms of discrimination against Dalits — including forced conversions and even mass murder. A dejected Mandal moved back to Kolkata. That is how Dalits’ dream of Pakistan turned into a nightmare. But the worst was yet to come.

Gen Zia introduced the separate electorate system, and allotted seats in elected houses to ‘Hindus and Scheduled Castes’. This collating of Dalits and caste Hindus not only stripped Dalits of the distinct political identity they had struggled for, it also pushed them back into the same Hindu fold, against which Mandal and the Muslim League had sided. Zia’s system was later changed, but the succeeding scheme continued to prefer upper-caste Hindus.

This resulted in rich caste Hindus obtaining ruling positions by using Dalits as their ladder. While there is little doubt that the rich in majority communities also get most party posts and parliamentary seats, in the Dalit context this has additional ramifications.

For example, the well-educated, upper-caste, Sindhi Hindus get admissions in higher education institutions on merit, and happen to occupy more seats than their proportion in the population. It makes sense for them not to demand quotas.

The absence of a quota, however, is against the interests of Dalits, who have a poor educational profile and seldom get good jobs. Their quota demands cannot make headway as long as their representatives belong to the upper-caste.

In matters of personal laws, the positions of Dalits and caste Hindus diverge on issues as important as divorce. Marriage cannot be dissolved according to the upper-caste code, but this is not so with Dalits. Upper-caste insistence that Hindu marriage law should not include a divorce clause has been a major impediment in its enactment.

The upper castes are a minuscule minority within Pakistani Hindus, and the vast Dalit electorate is all that democratically legitimises their politics. Yet, no sincere attempt to reach out to them has been made.

Community organisations formed by the upper castes have primarily charitable goals which, of course, do not include ‘annihilation of caste’. Their membership fees are often more than what most Dalits of Thar could ever pay, even with a loan guarantee taken for a lifetime of bonded labour.

Dalits complain bitterly that when an upper-caste girl is forcibly converted, caste Hindus parade the length of Sindh in protest, making headlines. Dalit women, on the other hand, suffer the same ordeal every day, but all they get from their community ‘leaders’ are empty promises.

The Dalit gathering in Mirpurkhas featured a large poster of Dr Ambedkar. Perhaps Mandal’s decision to call it quits on Pakistan was wrong. Pakistani Dalits will have to pick up the pieces of their broken dream, and start from where Mandal left off.

Splitting India II

In my article dated 20 September 2012, I had inadvertently given February 1940 as the date for the fall of Singapore. It was February 1942. That mistake, however, does not detract from the fact that the British were determined from the very start of WW II, and especially after the Congress ministries resigned in September 1939, to crush any challenge to their hold over the Indian empire which was a matter of great pride for them and a major supplier of troops for the war. These resignations were a major Congress miscalculation whose damage to their political influence was second only to the even more disastrous Quit India movement they launched in August 1942. These two decisions greatly undermined their ability to influence the course of the freedom struggle as all their cadres were incarcerated from August 1942 to June 1945.

During that absence from the political arena the Muslim League swept the key north-western provinces of Punjab and Sindh and made inroads into NWFP with their message that the creation of Pakistan would bring to an end the tyranny of the caste system and the economic exploitation of the moneylender. Thus the creation of Pakistan appeared to be a rational choice to the Muslims and they expressed it in the 1946 provincial elections when they voted overwhelmingly in favour of Pakistan. The Congress got the general votes including those of Hindus, Christians, Jains and others for a united India and the Sikhs of Punjab voted for the Panthic parties that wanted the Punjab partitioned, if India was partitioned. Such polarization meant that negotiations on the future of India were headed for a deadlock and the failure of the Cabinet Mission Plan of May 1946 confirmed that. Nehru's ill-considered July press conference in Bombay saying that the Congress would 'enter the Constituent Assembly unfettered by agreements and free to meet all situations as they arise' provoked an angry reaction from Jinnah who gave the call for direct action. The violence that broke out in Calcutta in August 1946 followed by more violence in Bihar, Garhmukhteshwar in UP and then Hazara district of KP finally engulfed the Punjab in March 1947.

Under the circumstances, Viceroy Lord Louis Mountbatten's 3 June 1947 Partition Plan to which Nehru, Jinnah, Baldev Singh and others tamely acquiesced was premised on an entirely false assumption: that the transfer of power would be peaceful. The warnings of Punjab's Governor Sir Evan Jenkins did not warrant such complacency at all.

The whole thing was based on a woefully flawed concept: while civil and military officialdom would have the choice to opt either for India or Pakistan the ordinary people would stay put! Mahatma Gandhi alone among all the leaders could sense that rivers of blood would flow and warned about it. On the other hand, Sardar Patel was prepared to let the Sikh leaders have a free hand in driving the Muslims of East Punjab out, though he probably did not realize that they were planning to use it to create, for the first time in history, a compact Sikh majority in some parts of East Punjab. Later, the Khalistan movement, which emerged in the 1980s, came to haunt the Indian state. Equally, since March 1947, local and Punjab-level Muslim League leaders were complicit in the attacks on the Hindus and Sikhs in the western districts. Neither Jinnah nor Liaquat Ali Khan took any steps to warn the Muslims of East Punjab that on 23 June 1947 the Punjab Assembly had voted to partition the province and a grave possibility existed of rioting. It is impossible to believe that they were not in the know of what was happening in the Punjab. On the other hand, the Congress leaders kept telling Lahore's Hindus and Sikhs to stay put as that city would be given to India, even when the Muslims were in a majority of 60 per cent there. All these details, along with extensive interviews with survivors are fully covered in my book, The Punjab Bloodied, Partitioned and Cleansed (Karachi: Oxford University Press, 2012).

In this regard, let me address a major criticism some readers have made of my argument that the partition of India was not necessarily the best option for Muslims. They have pointed out that the Indian Muslims have remained one of the poorest groups in secular India. Therefore the creation of Pakistan was necessary to save the Muslims from permanent Hindu domination. In principle this is a compelling argument in favour of creating Pakistan, but it needs to be put into perspective.

Mr Jinnah had prepared his brief on a separate Pakistan on the basis of categorical rejection that a Hindu-majority government could ever be fair to the Muslims. When he was asked what would happen to the most vulnerable, deprived and poor sections of Muslims from Muslim-minority provinces if they were left behind in India, he had asserted that one-third of Muslims should not prevent two-thirds of them escaping Hindu domination. It was a typical utilitarian argument deriving from the notion of the greatest good of the greatest number rather than the greatest good of all. However, in August 1947 when some reporters asked him before he left Delhi for Karachi as to what message he wanted to give to the Muslims who would remain behind he said that they should become loyal Indian citizens and he expected the Indian government to treat them fairly. His line of argument had thus changed fundamentally - it acknowledged that a Congress government (upper-caste Hindu dominated) could treat them fairly.

As I said in my previous article, only three per cent of the Muslims from the Muslim-minority provinces of northern India, mainly the intelligentsia migrated to Pakistan. The RSS, Hindu Mahasabha and many Hindu and Sikh refugees who had lost family and property in what became Pakistan wanted each and every Muslim driven out of India. Mahatma Gandhi's last fast-unto-death was not only to press the Indian government to pay Pakistan Rs 550 million as its rightful share of the colonial treasury, but also to insist that the campaign to expel Muslims should cease. It culminated with his assassination at the hands of Nathu Ram Godse, but it compelled the Indian government to adopt strict measures to prevent attacks on Muslims. I must give full credit to Jawaharlal Nehru that while he was prime minister he tried his best to protect the Muslims.

It is not possible to explain in detail in a media column why Congress governments after Nehru deviated from their protective policy towards Muslims. Suffice it to say that after Mrs Indira Gandhi came to power Nehruvian secularism became less of a matter of principle and more of expediency and electoral calculation. Later Congress governments were led by men of straw and the Babri Mosque attack by BJP goons in December 1992 could take place because the Congress government of Mr Narasimha Rao remained passive. It is only after Mr Manmohan Singh came to power that the sad plight of the Muslim minority was given some attention. The Sachar Committee appointed by Prime Minister Manmohan Singh in 2006 submitted a 403-page report which stated that the status of Indian Muslims was somewhere between Hindu OBCs (other backward castes) and the scheduled castes and tribes. No doubt this has happened because discrimination takes place against the Muslims in a systematic manner even though formal (constitutional) secularism does not discriminate between citizens on the basis of their creed or ethnicity.

However, here too we need to consider some complications. The Muslims of northern India have always consisted of two distinct groups: the high-born ashraaf who claim descent from forbears of foreign origin and the vast majority who are converts from the lower rungs of Hindu society. I have seen reports which name Muslim zamindars and taalukdars of northern India who were active in the struggle for Pakistan, but when partition took place they stayed on to retain ownership of their properties. Some of them later sold off their land and other assets and then migrated to Pakistan or to the West. Some devised novel ways of having the best of both words. Nothing compares to the genius of Raja Sahib Mahmudabad, famous as the financier of the Muslim League and one of the closest associates of Mr Jinnah. He left his son and wife in Mahmudabad while he shifted to Pakistan with his daughters. The Indian government had impounded his vast property worth currently Rs 30,0000 million on grounds that it was 'enemy property' since he had migrated to Pakistan. His son contested the case saying that he was the rightful heir as his father had transferred his property to him before he shifted to Pakistan. In 2005 the Indian Supreme Court restored the properties to him. So, the rich and powerful were not hit by the calamity of the partition. Nawabzada Liaqat Ali Khan did lose his estate in eastern Punjab as did Nawab Mamdot but that happened because the Sikhs and Congress joined hands to force the partition of Punjab on the same lines on which the Muslim League had demanded that India should be partitioned - on the basis of contiguous religious majorities in some parts of the subcontinent and its provinces. The same happened to Muslim-majority Bengal.

It is therefore the Muslims from artisanal and landless working backgrounds - Muslim Dalits - who potentially would suffer most from a partitioned India. Historically they were always despised by the ashraaf. I have read both Barelvi and Deobandi texts where the superiority of the ashraaf has been justified on grounds that they alone represent true Islam. Of course there are exceptions especially in Deobandi writings. In this regard I might as well add that traditional Shia social and political theory is even more hierarchical than that of the Sunnis. In Pakistan we practice caste prejudices but pretend that since Islam has no caste there is no caste oppression among us. Moreover, caste-like discrimination and persecution in Pakistan has also taken a sectarian form and our wrath is directed against all those we classify as non-Muslims.

At any rate, when the Muslim intelligentsia left for Pakistan the ulema, whose standard refrain has always been that Muslims should not integrate into mainstream society because that would dilute their Islamic identity, took over the leadership of the poorer sections of Muslim society. Instead of encouraging them to get a modern education they fostered a siege mentality and tried to insulate the Muslims from modernizing social trends. Consequently the level of education among these poor Muslims is very low, even lower than the Dalits, who because of the reservation system, have been helped to get education and jobs. A movement has now started gaining pace among Muslims of artisanal and Dalit backgrounds demanding that they too should be included in the reservation system. It remains to be seen if the Indian government would extend them that 'privilege'. The Sachar Report stopped just short of recommending it; it instead recommended special educational inputs from the government to help the Muslims. I need not overemphasize that the RSS and other Sang Parivar groups are always opposed to Muslims being included in the reservation policy. The attacks on Muslims in Gujarat in 2002 were also masterminded by these groups.

Here, I pose a moral question: are we in Pakistan prepared to help such vulnerable Muslims? All I know is that we have not even accepted the Biharis who sided with Pakistan during the 1971 civil war in the former East Pakistan. Unlike Israel which welcomes all Jews from anywhere in the world to settle in Israel, because it is a state created for the Jewish people, we have no open-door policy for oppressed Indian Muslims. So our moral concern for them is hypocritical. There is a way to bring to an end their agony: let us open our arms and welcome them. Let us declare that the 180 million Indian Muslims are entitled to enter Pakistan and become its citizens because Pakistan was created to protect them from Hindu domination and discrimination. The fact is many won't because I know the secular-minded Muslims find Pakistan a difficult proposition as they are used to a less conformist lifestyle than what exists in contemporary Pakistan. Still millions might want to migrate to Pakistan because they may believe that as an Islamic state it would be fair to them.
The Sindhis would assail my solution, saying that they have had bitter experience with an open embrace to the Mohajirs - it resulted in them (Sindhis) effectively being sidelined and marginalized in the towns and cities of Sindh, including Karachi and Hyderabad. On the other hand, the Mohajirs now realize that given their smaller numbers they would in the long run be swept away by the much bigger nationalities of Pakistan. They feel beleaguered and threatened. Consequently, if there is no scope for Indian Muslims to find refuge in Pakistan then we can only hope that enlightened Indian rulers would protect the Indian Muslims just as Mahatma Gandhi wanted and Nehru tried. I see no other option to this sad legacy of a partitioned India.

There are two philosophical standpoints from which one can support or oppose societal events and situations, one absolutist, the other utilitarian. The former stands for a categorical rejection of the principle of partition as a solution to national disputes while the latter has to do with pragmatism with regards to the pros and cons of partitioning territory to solve national disputes.

Let me admit that although partitioning territory to solve disputes between adversarial nationalist movements and parties is not something I am intellectually comfortable with because it validates tribalism rather than human empathy and solidarity for building community, at times it is the only solution which is morally and practically correct. Partitioning former Sudan to let the Black Africans escape genocide at the hands of the putative Arabs of northern Sudan was an appropriate solution; East Timor getting out of the clutches of the Indonesian state has also been the best option. I hope one day the Palestinians in the occupied West Bank are liberated from brutal Israeli rule.

However, I don't think the partition of India and of Bengal and Punjab belong to the category of intractable disputes that could not have been managed through appropriate democratic arrangements. The so-called Hindu-Muslim problem that dominated politics in British India from the twentieth century onwards till it culminated in the biggest forced migration of people in history and one of the most horrific cases of genocide and ethnic cleansing- 14-18 million forced to flee and between 1-2 million killed - left large minorities in both states. The only difference being that in India the Muslim minority could stay put after some three per cent of the Muslims from Muslim-minority areas migrated to Pakistan but Hindus and Sikhs had to leave almost to the last man in Punjab and the settled areas of Khyber-Pakhtunkhwa. Very few could stay behind in the tribal areas and in Balochistan. It was only in interior Sindh that a community of some significance could remain behind. Not surprisingly, such upheaval bequeathed a bloody and bitter legacy of fear and hatred to India and Pakistan. The three wars and the Rann of Kutch and Kargil miniwars and constant tension along the Line of Control drawn in the former Jammu and Kashmir State has meant not only huge, wasteful expenditure on military and defence but also a profoundly vitiating impact on democracy, development and pluralism.

Maulana Abul Kalam Azad warned that a partitioned India would mean a partitioned Muslim community, engender Hindu nationalism and create a Pakistan of sectarian conflicts that would become easy bait for the West


The Muslim League's demand for the partition of India was initiated by Viceroy Linlithgow in March 1940 when he instructed Sir Muhammad Zafrulla to convey to the League leadership that the government wanted them to demand separate states. The colonial government was hoping to checkmate the Indian National Congress's ambition to force a British withdrawal from India while WW II was raging and the British had suffered their first defeat in more than 200 years at the hands of an Asian power -the Japanese, who forced a humiliating surrender in Singapore in February 1940. It is not important who is the real author of the two-nation theory but there can be no doubt that the idea of separate states for Muslims was born in the viceroy's office. Let me say that the British were not at all thinking of partitioning India at that time nor was the Muslim League confident that such an idea could be realized without major upheavals taking place.

In these series of articles I am not going to present my version of how India and the two Muslim-majority provinces were partitioned or why. I am going to present some arguments to suggest that it was not necessarily the best solution for anyone, especially the Muslims of the Indian subcontinent. In this regard I must invoke Maulana Abul Kalam Azad's forebodings that a partitioned India would mean a partitioned Muslim community and it would help Hindu nationalism in India while creating a Pakistan that would get embroiled in sectarian conflicts and become easy bait to the West. The Jamiat Ulema-e-Hind had a similar standpoint. Consequently, important sections of the Muslim population of India had reservations against the partition, though by 1945 a large majority had begun to support the idea of Pakistan.

The so-called Hindu-Muslim problem was not really solved by the partition: it simply converted it into an India-Pakistan confrontation with wars that resulted in disastrous consequences for democracy, development and pluralism. In India, it created a discourse of Muslim betrayal during the freedom struggle, which was then held against the Muslims who remained in India (nearly as many as were in West Pakistan, now Pakistan). In Pakistan, it generated the intractable controversy about who is a Muslim. As we know each attempt to define a Muslim has meant more people being excluded from that category on the basis of them holding beliefs contrary to the beliefs of a particular sect or sub-sect. In both cases it gave impetus to majoritarian nationalism, which has since then preyed on the minorities as unwanted, fifth columnists. Indian Muslims are routinely demonized in RSS, Shiv Sena and other members of the Sangh Pariwar of Hindu extremists while in Pakistan we have effectively been making life difficult for the miniscule Hindu minority. There is, however, a fundamental difference. The Indian constitution and legal system do not discriminate between religious groups when it comes to their political rights. In Pakistan they do.

The demographic structure of pre-partition India was such that no group had absolute majority. The rough percentage was 7: 4 Muslims (200 million Hindus 90 million Muslims). Now, the Hindu group was stratified into at least three caste compartments: the three upper castes of Brahmins, Kshytrias and Vaishyas (15-20 percent), and the other backward classes or castes (some 50 per cent at least), comprising various farming and other communities, quite powerful locally in different parts of India, and the so called scheduled castes and tribes (22.5 per cent).

Among the three Hindu caste compartments there were some shared religious and cultural features but also demarcations, so all Hindus somehow as one body oppressing all Muslims was very unlikely. On the contrary, it meant that Hindus needed to continue reforming and modernizing towards greater equality. The Muslims were at least 25 per cent of the population, dispersed everywhere and concentrated in two very significant geo-strategic zones of north-eastern and north-western India. The Muslims were not a compact group either. Differences of sect and ethnicity existed even among them. Then there were millions of Christians, Sikhs, Buddhists, Jains and so on. Additionally, there were regional leaders and parties. All this prepared India for a grand experiment in pluralist democracy where it would have been in the best interest of the groups and sub-groups to work together in power sharing and sharing of resources.


Contrary to a widely held view that Muslims everywhere lagged behind Hindus and Sikhs in employment, the fact is that the Muslims (especially Punjabis and Pathans) constituted some 36-40 per cent of the British Indian Army. In the Muslim minority province of UP more than 50 per cent of the police were Muslims as compared to the 17 per cent of their population strength. In both Bengal and Punjab, which had Muslim majorities the police were Muslim in far greater numbers than their proportion of the population. Thus for example in the Punjab 73 per cent of police was Muslim as against only 57.1 per cent of their population strength. The British always employed minorities in the police and military, for obvious reasons. In other branches of the administration the Muslim percentage was increasing though Hindus and Sikhs were ahead of them. Sir Fazl-e-Hussain had introduced quotas for Muslims in some important educational institutions and that had helped the steady increase in percentage of educated Muslims .




Muslims who went to school and sought employment had a fair opportunity to find one. The problem was that the negative Muslim state of mind induced in the aftermath of the 1857 uprising which brought to an end even symbolic Muslim suzerainty over India, and the propaganda of the ulema that Western education would mean Muslims converting to Christianity prevented the Muslims from taking to education whole-heartedly. The British brought with them a new economic order based on banking, investments, stock exchange - all considered inappropriate in dogmatic Islamic terms. The Hindus and Sikhs made use of the new opportunities and moved ahead. I know many Muslim families of Lahore whose elders educated themselves and were as successful as Hindus and Sikhs in acquiring property and were part of the elite.


No doubt commercialization of agriculture resulted in the Muslim peasantry getting trapped in debts to moneylenders. The alternative was the landlord who extracted more out of the peasants through unpaid services on his lands and in his household and the Muslim peasants preferred to go to the Hindu karar or moneylender who was a local person who offered loans on quite reasonable terms. Some moneylenders were extortionists but not all. In any case, the debt burden was a problem in the Punjab and Sir Chhotu Ram, the leader of the Punjab Unionist Party introduced legislation in 1937 which cancelled past debts. However, that did not mean the needs of the peasants for capital also came to an end. Money-lending continued through Muslim front men but as an institution it was certainly greatly weakened and modern banks began to be established in the Punjab.


When the focus of the Muslim separatist movement shifted from northern India, (where the Muslim landed elite was its main protagonist) to the Muslim-majority provinces of north-western India in 1940, the creation of Pakistan began to be presented as a way of ending Hindu domination, at least in areas where Muslims were in a majority - i.e. the north-western and north-eastern zones of the subcontinent. The partition riots resulted in Hindus and Sikhs being expelled from the Muslim majority provinces of north-western India and thus a lot of businesses and property came into the hands of Muslims. It also meant that Muslims found space to make upward mobility which was obstructed while these non-Muslims were based there.


I sometimes wonder if those who consider this as a legitimate solution to Muslim poverty ever think of how it would affect Muslims and other immigrants in the West if anti-immigration parties succeed in expelling immigrants on grounds of property and jobs that ought to be made available to the indigenous white population to solve the problem of unemployment. I am sure no Muslim in Europe who has worked hard and made progress would consider it a fair and legitimate way of bringing relief to unemployed Europeans. Some people argue that the Pakistan movement was a class struggle between Hindu and Sikh haves and Muslim have-nots. This is at best vulgar Marxism. The landlord class was the mainstay of the Muslim League and to believe they were allies in a liberation struggle to establish a fairer society is sheer lunacy.


One thing more, let's suppose that the partitions of Punjab and Bengal had not taken place even if India had been partitioned. That would have meant the Hindus and Sikhs retaining their properties in Pakistan. How would that have solved the problem of Muslim economic backwardness in one go except by confiscating the properties of non-Muslims. The other way would be to help Muslims get interested in education despite their reservations. That was already happening in undivided India in the Muslim-majority provinces and would have continued had India remained united. India was never ever conceived as a unitary state. It was going to be a federation. Thus the partition of these two provinces only helped a quicker change of property ownership from Hindu-Sikh to Muslim hands by driving the Hindus and Sikhs out.


The fact is that the Hindus and Sikhs took to western education and adjusted to the modern capitalism economy with ease and thus progressed economically. They worked hard and acquired wealth. They did not steal it from Muslims who were negatively inclined towards modern education as well as modern business and commerce. The moneylender developed in the context of the new economy of commercial crops and since Muslims were not willing to move into it, the Hindus and Sikhs did. Sir Chhotu Ram's reforms of 1937 to a large extent weakened the moneylenders and with modern banking their relevance decreased even more. So, efforts were underway to rectify such lopsided economic relations. On the other hand, research shows that the landlords (mostly Muslims) used to lend capital informally to the peasants and exploit them even more completely by making them work for them on their lands and making their womenfolk serve in the household. The landlord, the true parasite never got identified as an exploiter the same way as the moneylender.
